Cannabis Penalties in Oklahoma

Without a card: up to 1 year for simple possession. HB 1163 (2025) dropped the trafficking threshold from 1,000 to 25 pounds. With a card, you're protected — within limits.

Possession Penalties (Without a Medical Card)

If you do not hold a valid OMMA patient card, cannabis possession penalties depend on the amount and whether you claim a medical need:

Offense Classification Penalty
Possession without card (≤1.5 oz, medical claim) Fine-only misdemeanor Up to $400 fine
Possession without card (no medical claim) Misdemeanor Up to 1 year / $1,000
Possession near schools / intent to distribute Felony Enhanced penalties
Aggravated trafficking (≥25 lbs, HB 1163) Felony 4 years to life / up to $500,000
DUI (any detectable THC) Misdemeanor (1st offense) 10 days–1 year
DUI (2nd within 10 years) Felony 1–5 years
Public smoking/vaping Same as tobacco violations Fines vary

The "Medical Claim" Distinction

Oklahoma law creates a unique two-tier system for non-cardholders caught with small amounts:

Amount With Medical Claim Without Medical Claim
1.5 ounces or less Fine-only misdemeanor — $400 maximum, no jail Misdemeanor — up to 1 year jail, $1,000 fine

If you are caught with 1.5 ounces or less and claim the cannabis is for medical purposes, the penalty is a fine-only misdemeanor capped at $400 with no jail time. Without a medical claim, the same amount carries up to 1 year in jail and a $1,000 fine. This provision reflects the broad public support for medical cannabis in Oklahoma, even for those who have not obtained a card.

Felony-Level Offenses

The following situations elevate cannabis charges to felony level:

Offense Classification Penalty
Possession near schools Felony Enhanced penalties — varies by amount
Possession with intent to distribute Felony Enhanced penalties — varies by amount
Distribution/sale to minors Felony Enhanced mandatory minimums
Trafficking (25 lbs or more) Felony 4 years to life, up to $500,000 fine

HB 1163 (2025): New Trafficking Threshold

HB 1163, enacted in 2025, dramatically lowered Oklahoma's cannabis trafficking threshold from 1,000 pounds to 25 pounds. This is one of the most significant penalty changes in the state's cannabis law:

  • Previous threshold: 1,000 lbs of cannabis = trafficking
  • New threshold: 25 lbs of cannabis = trafficking
  • Penalty: 4 years to life in prison, up to $500,000 fine

This 40-fold reduction in the trafficking threshold was driven by concerns about illegal grow operations in Oklahoma. The law targets large-scale unlicensed operations but could also affect patients or caregivers who significantly exceed their legal limits.

The 25-Pound Threshold Is Low

Under HB 1163, possession of 25 pounds or more of cannabis triggers trafficking charges carrying 4 years to life in prison. While this is aimed at illegal grow operations, it is important for caregivers managing multiple patients' supplies to stay well within their legal limits.

DUI Penalties

Cannabis DUI carries its own penalty schedule under 47 O.S. § 11-902:

Offense Jail Time Classification
1st DUI 10 days to 1 year Misdemeanor
2nd DUI (within 10 years) 1 to 5 years Felony

Oklahoma's DUI law uses a zero-tolerance standard — any detectable THC or metabolites constitutes DUI. Your OMMA card is not a defense. For complete details, see our DUI & Driving page.

Patient Protections

Registered OMMA patients are protected from criminal penalties for cannabis activities within their legal limits:

  • Possession within limits (3 oz on person, 8 oz at home, 1 oz concentrate, 72 oz edibles/topicals)
  • Cultivation of up to 6 mature plants + 6 seedlings
  • Purchase from licensed dispensaries

Patient immunity does NOT cover:

The $100 Card Changes Everything

The difference between having and not having an OMMA card in Oklahoma is dramatic. With a card, 3 ounces on your person is completely legal. Without one, even 1.5 ounces can result in jail time. The $100 card (valid for 2 years) provides immunity from criminal penalties while within limits.
