Can Out-of-State Patients Buy Cannabis in Oklahoma?

Yes — with a temporary license. Oklahoma offers a 30-day temporary patient license for out-of-state visitors who hold a valid medical cannabis card from their home state. This temporary license gives you the same rights as an Oklahoma resident patient, including the right to purchase from dispensaries, possess cannabis, and even grow plants.

There is no recreational cannabis market in Oklahoma. Without a medical card — either an OMMA card or a temporary out-of-state license — any cannabis possession is illegal.

Temporary License Details

Full Rights for Temporary License Holders

Oklahoma's temporary license is unusually generous. Unlike most states that limit visiting patients to dispensary purchases only, Oklahoma grants full patient rights:

  • Purchase from any OMMA-licensed dispensary
  • Possess 3 oz flower on person, 8 oz at home, 1 oz concentrate, 72 oz edibles/topicals
  • Grow 6 mature plants + 6 seedlings (rare for temporary licenses)
  • Consume in private residences
  • No daily or monthly purchase caps
Home Growing for Visitors

Oklahoma is one of the very few states that allows out-of-state temporary license holders to grow cannabis plants. If you are staying in Oklahoma for an extended period (up to 30 days), you can cultivate 6 mature plants and 6 seedlings on private property, following the same rules as resident patients.

How to Apply for a Temporary License

  1. Verify your home-state card is valid. Your medical cannabis card from your home state must be current and unexpired at the time of application.
  2. Visit the OMMA portal. Go to omma.ok.gov and select the out-of-state temporary license application.
  3. Upload required documents. You will need:
    • A copy of your valid home-state medical cannabis card
    • A government-issued photo ID
    • A passport-style photograph
  4. Pay the $100 fee. Payment is processed online as part of the application.
  5. Wait for processing. OMMA processes applications within 14 business days. Plan accordingly and apply before your trip.
Apply Before Your Trip

With up to 14 business days for processing, apply for your temporary license well before you plan to arrive in Oklahoma. Do not wait until the last minute — you cannot purchase cannabis without an approved license.

Texas Patients: Ineligible

Texas residents are ineligible for Oklahoma's temporary patient license. The reason: Texas operates a Compassionate Use Program (CUP) that does not issue standard medical marijuana cards. Oklahoma requires a valid medical cannabis card from the applicant's home state, and Texas CUP registry cards do not meet this requirement.

This affects a significant number of potential applicants, given that Texas is Oklahoma's largest neighboring state. If you are a Texas resident, you currently have no legal path to purchasing cannabis in Oklahoma.

Caregivers for Out-of-State Patients

Oklahoma's caregiver system is also available to out-of-state patients:

  • Each caregiver can serve up to 5 patients
  • Caregivers can possess cannabis and cultivate plants on behalf of their patients
  • A caregiver serving 5 patients can grow up to 30 mature plants + 30 seedlings
  • Caregiver registration is free through the OMMA portal

What You Cannot Do

  • Transport cannabis across state lines. Even with valid cards in multiple states, interstate transport is a federal crime. Do not bring cannabis from Oklahoma to your home state.
  • Consume in public. The same private residence rules apply to temporary license holders.
  • Drive with THC in your system. Oklahoma has zero-tolerance DUI laws for THC and metabolites. Your temporary license is not a defense.
  • Fly with cannabis. Airports are federal property. TSA operates under federal law. Do not attempt to fly with cannabis from any Oklahoma airport.
  • Mail or ship cannabis. USPS is a federal agency, and private carriers also prohibit cannabis shipments.

Eligible vs. Ineligible States

Status Details
Eligible Any state, territory, or tribal nation that issues a standard medical cannabis/marijuana patient card
Ineligible Texas — Compassionate Use Program does not issue standard MMJ cards
Verify States with non-standard programs (low-THC-only states, CBD-only registries) may not qualify. Check with OMMA before applying.

Practical Tips for Visiting Patients

  • Apply early. Submit your application at least 3 weeks before your trip to account for the 14 business-day processing window.
  • Carry both cards. Keep your home-state medical card and your Oklahoma temporary license with you at all times.
  • Finish everything before leaving. You cannot take cannabis out of Oklahoma. Consume or dispose of all cannabis before departing.
  • Know the DUI law. Zero tolerance for THC/metabolites. Use rideshare after consuming.
  • Private consumption only. Hotels, Airbnbs, and private residences — check smoking policies before consuming.
